Terms of Service

These Terms of Service ("Terms") govern your access to and use of https://wordykid.com and the related WordyKid website, games, AI learning tools, digital products, content, and services (collectively, the "Service"). If you access or use the Service, you agree to these Terms.
The Service is operated by LiLoLi Studio, an Israeli sole proprietorship operating WordyKid ("LiLoLi Studio", "we", "us", or "our"). Contact email: contact@wordykid.com.
1. Eligibility, Parent Authorization, and Child Use
The Service is intended for children and families, but any legally binding act relating to the Service, including consent, purchases, account linking, payment authorization, refund requests, and acceptance of these Terms where required by law, must be completed by a parent or legal guardian or another legally authorized adult.
If you are a parent or legal guardian, you are responsible for supervising the child's use of the Service, reviewing uploads before submission, ensuring the child does not submit personal or sensitive information, determining whether the Service is appropriate for the child, and monitoring the child's use of public-facing features such as nicknames and leaderboards.
By allowing a child to use the Service or by making a purchase, you represent and warrant that you are authorized to do so on behalf of yourself and, where applicable, the child.
2. No Educational, Medical, or Professional Guarantee
The Service is provided for educational and entertainment purposes only. We do not guarantee any specific learning outcome, grade improvement, language proficiency, exam result, school placement, therapeutic outcome, or educational suitability for any child. The Service is not professional educational, medical, legal, psychological, or therapeutic advice.
3. License to Use the Service
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your own personal, family, and non-commercial use.
You may not, and may not permit any third party to, copy, sell, resell, rent, lease, license, distribute, publicly perform, publicly display, modify, adapt, translate, create derivative works from, reverse engineer, decompile, disassemble, scrape, data-mine, use bots or automation against, bypass security of, interfere with, frame, mirror, or otherwise exploit the Service or any part of it except as expressly permitted by applicable law and these Terms.
4. Accounts, Profiles, Nicknames, and Cloud State
The Service may not require a traditional registered account for all gameplay, but it may create or maintain pseudonymous player profiles, technical identifiers, cloud state, or linked parent purchase state to deliver functionality, maintain continuity, enforce access rights, support security, and prevent fraud or abuse.
You are responsible for keeping public-facing nicknames appropriate and non-identifying. Do not use real names, contact information, or sensitive information in display names, uploads, or other user inputs.
5. Paid Products and Digital Content
The Service may offer paid digital products, features, or entitlements, including one-time access unlocks for games or features and one-time AI credit packs or similar consumable digital entitlements.
Unless otherwise stated at checkout, paid digital products are licensed, not sold, to you. Any description such as "lifetime", "permanent", or similar means access for the commercial life of the purchased digital offering while we continue to make that offering available, except where applicable law requires otherwise. Paid entitlements are personal, non-transferable, may not be sublicensed, and have no cash value.
Unless otherwise stated at checkout or in the product description, AI credit packs are consumed when an eligible AI request is processed and may expire after the period shown at checkout or in the product description. Expired, used, suspended, refunded, revoked, promotional, or abuse-related credits may be cancelled or removed.
6. Checkout, Merchant of Record, Taxes, and Payment Processing
Checkout and payment processing are handled by Lemon Squeezy as merchant of record. This means the transaction is processed through Lemon Squeezy and may be subject to Lemon Squeezy's checkout terms, buyer terms, tax handling, fraud screening, and payment policies in addition to these Terms.
You authorize us and Lemon Squeezy to charge the amount shown at checkout, including applicable taxes, fees, or currency conversion charges. Prices, product availability, taxes, territories, and accepted payment methods may change at any time.
If a purchase is completed before an email address or other account-linking method is connected, the purchased access may remain tied only to the current local device identity and browser state until account linking is completed. This means the purchase may continue to work on the current device, but access may not be restorable on a different device, browser, or after local data is lost, cleared, reset, or replaced unless the parent or legal guardian completes account linking afterward. For that reason, we may show prompts before checkout, after checkout, or after purchase return encouraging account linking so the purchase can be saved and restored across devices.
7. Immediate Performance of Digital Content
By purchasing digital content, digital access, or AI credits and requesting immediate access, delivery, activation, or use, you expressly request immediate performance of the digital service or digital content. To the extent permitted by applicable law, you acknowledge that once performance begins, access is granted, or credits are consumed, your statutory withdrawal or cancellation right may be reduced, lost, or become subject to a proportionate charge.
8. Refunds, Chargebacks, and Revocation
Refunds are handled in coordination with Lemon Squeezy and are subject to applicable law, Lemon Squeezy's buyer terms, the specific product purchased, whether performance has begun, whether credits have been consumed, and any evidence of fraud, abuse, or misuse.
Except where mandatory law requires otherwise, we may deny or limit refunds for digital content or digital services that were delivered immediately, activated, substantially consumed, customized, abused, or used in violation of these Terms. Requests for unused AI credit packs or unused access unlocks may be reviewed on a case-by-case basis. If a refund, chargeback, reversal, dispute, fraud flag, or payment failure occurs, we may suspend, revoke, or limit the related entitlements, credits, or access to the extent permitted by law and consistent with any merchant-of-record process.
9. User Content, Uploads, and Inputs
The Service may allow you to submit or upload text, prompts, worksheets, screenshots, photos, images, or other content ("User Content"). You retain any rights you may have in your User Content, subject to the limited rights you grant in these Terms. You remain solely responsible for all User Content you submit and for the consequences of submitting, sharing, generating, or requesting outputs from it.
You grant us and our service providers a worldwide, non-exclusive, royalty-free license to host, copy, transmit, store, process, translate, transform, display, and otherwise use User Content solely as reasonably necessary to operate, secure, support, troubleshoot, improve reliability of, and legally comply in connection with the Service, including generating requested AI outputs, preventing abuse, enforcing our policies, responding to legal requests, and resolving disputes. We do not acquire ownership of your User Content by virtue of this license.
You represent and warrant that you have all rights, permissions, consents, and legal authority needed to submit the User Content and to authorize us and our service providers to process it for the requested feature. This includes, where applicable, permission from the parent or legal guardian of a child depicted in, associated with, or identifiable from the User Content, and any permissions needed for copyrighted materials, school materials, worksheets, photos, likenesses, trademarks, or other third-party content.
You must not upload or submit any content that is unlawful, infringing, deceptive, defamatory, abusive, sexually explicit, exploitative of children, hateful, violent, invasive of privacy, malware-related, or otherwise harmful. Unless strictly necessary for a specific feature and lawfully authorized, do not upload faces, identifiable images of children, government IDs, payment data, health records, full names, school records containing personal details, private addresses, or other sensitive personal information.
We may screen, block, refuse, suspend processing of, remove, disable access to, or delete any User Content at any time, with or without notice, if we believe it may violate law, these Terms, the rights of another person, child-safety standards, or the security or integrity of the Service. We are not obligated to monitor User Content, and we are not responsible for preserving, storing, or restoring User Content once removed or deleted.
If you believe any content available through the Service infringes your copyright, privacy, or other rights, contact contact@wordykid.com with enough detail for us to investigate and take appropriate action.
10. AI Features and AI Output Disclaimer
The Service may use automated systems and third-party AI providers to process inputs and generate outputs. AI outputs may be incomplete, inaccurate, offensive, biased, mislabeled, outdated, or unsuitable for a child or a particular educational purpose. A parent or guardian should review AI-generated results before relying on them.
You are responsible for reviewing generated content before use. We do not guarantee that AI outputs are original, error-free, non-infringing, pedagogically appropriate, or fit for any specific purpose.
11. Public Features and Leaderboards
The Service may include public or semi-public features such as leaderboards. If enabled, nicknames, level information, and gameplay-related scores, balances, or status indicators may be visible to others. You are responsible for using only a non-identifying nickname and for supervising any child's use of these features.
12. Prohibited Conduct
You agree not to:
use the Service for unlawful purposes; impersonate another person; submit false payment or identity information; abuse refund processes; evade regional restrictions or sanctions; interfere with the Service or its security; attempt unauthorized access; exploit children; upload malware or harmful code; create multiple profiles to circumvent limits; manipulate leaderboards, rewards, or credits; scrape or harvest data; use the Service to build or train competing products; or otherwise misuse the Service or third-party tools integrated with it.
13. Intellectual Property
The Service, including software, source code, interfaces, workflows, game mechanics, translations, text, graphics, music, sounds, datasets, structure, branding, and all related intellectual property rights, are owned by us or our licensors and are protected by copyright, trademark, trade secret, and other laws.
WordyKid, LiLoLi Studio, and related names, logos, and product elements are protected to the extent applicable law allows. Except for the limited license granted in these Terms, no rights are granted to you.
If you believe that any content, output, upload, image, text, or other material available through the Service infringes your copyright, trademark, privacy, publicity, or other legal rights, contact contact@wordykid.com with enough detail for us to investigate. Please include a description of the rights claimed, the specific material at issue, its location in the Service if available, your contact details, and any supporting information reasonably necessary for review.
We may remove, disable access to, or restrict allegedly infringing or otherwise unlawful material while we review a complaint, and we may suspend or terminate access for repeat or serious violations where appropriate.
14. Feedback
If you send us feedback, suggestions, ideas, bug reports, or improvement proposals, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free right to use, reproduce, modify, adapt, publish, and otherwise exploit that feedback without restriction or compensation, provided this does not reduce any rights you have under mandatory law in your personal data.
15. Suspension, Restrictions, and Termination
We may suspend, restrict, remove content from, or terminate access to all or part of the Service at any time, with or without notice, if we reasonably believe this is necessary to protect children, users, us, the Service, third parties, or the integrity of the platform, to comply with law, to investigate misconduct, to respond to payment issues or chargebacks, or to enforce these Terms.
You may stop using the Service at any time. Sections that by their nature should survive termination will survive, including sections on payments already due, refunds, intellectual property, limitations of liability, dispute terms, and protection of our rights.
16. Third-Party Services
The Service may rely on third-party services, including payment processors, merchant-of-record providers, cloud providers, analytics providers, and AI providers. Those third parties may have their own terms, policies, downtime, restrictions, or eligibility rules. We are not responsible for third-party services outside our reasonable control.
17. Optional Browser Push Notifications
The Service may offer optional browser push notifications for free rewards, new games, practice ideas, feature updates, service notices, and relevant platform updates. Notifications require browser permission and may involve storing push subscription tokens, endpoints, or similar browser/device identifiers under the authenticated user profile.
Enabling notifications does not guarantee an immediate reward. You can disable notifications at any time in browser or device settings. Any child-related use or consent must remain authorized and supervised by a parent or legal guardian where applicable.
18. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, availability, security, accuracy, or educational effectiveness.
We do not warrant that the Service will be uninterrupted, error-free, secure, or available at all times, or that defects will be corrected, or that content or outputs will be accurate or suitable for your needs.
19. Limitation of Liability
To the maximum extent permitted by law, LiLoLi Studio and its owners, affiliates, contractors, service providers, and licensors will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages, or for any loss of profits, revenue, business, goodwill, use, data, or anticipated savings arising out of or related to the Service, whether in contract, tort, negligence, strict liability, statute, or otherwise.
To the maximum extent permitted by law, our aggregate liability for all claims arising out of or related to the Service will not exceed the greater of: the amount you paid us or through our merchant-of-record partner for the specific product or service giving rise to the claim during the 12 months before the event giving rise to the claim, or USD 100.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including mandatory consumer rights or liability for fraud where such exclusion is prohibited.
20. Indemnity
To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless LiLoLi Studio and its owners, affiliates, contractors, service providers, and licensors from and against claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable legal fees, arising out of or related to your breach of these Terms, your misuse of the Service, your User Content, your violation of law, or your infringement of any rights of another person or entity.
21. Export, Sanctions, and Territory Restrictions
You may not use, access, purchase, export, or re-export the Service where prohibited by applicable law or where you are subject to sanctions, embargoes, or trade restrictions. We may block or restrict territories, users, payment methods, or transactions at any time for legal, compliance, fraud, or risk reasons.
22. Institutional and School Use
The consumer version of the Service is intended for individual or family use. Institutional, classroom-wide, school, district, or enterprise use may require a separate written agreement or separate privacy and data-processing terms. We may refuse or limit institutional use without such an agreement.
23. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Israel, excluding its conflict-of-laws rules. Subject to mandatory consumer protection laws that grant you a non-waivable right to bring claims in another forum, you agree that the competent courts located in Tel Aviv, Israel will have exclusive jurisdiction over disputes arising out of or related to these Terms or the Service.
24. Changes to the Terms
We may modify these Terms from time to time. The updated version becomes effective when posted, unless a later effective date is stated. Your continued use of the Service after the effective date of revised Terms means you accept the revised Terms.
25. General
If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. Our failure to enforce any provision is not a waiver. These Terms, together with any applicable checkout terms, product page disclosures, and the Privacy Policy, form the entire agreement between you and us regarding the Service for consumer use.
